I assume that they can't really let the movie die if they put it out. They have a major streaming service so wouldn't the contract require them to stream it? If they lose the suit then that's the way that most people who were are going to see it are probably going to watch it even if it gets a proper theatrical release. You wouldn't need to "put in extra effort" to find it. In the 90s even if it was obliged to get a video release it might be hard to find the video. If Amazon is contracted to distribute it via streaming there's a limit to how far they can try and bury a release.
