Undocumented entry? That's a crime. Visa overstay or some other form of no longer having valid documentation? Non-criminal civil offense.

Many ICEW detentions have been of people falling into the latter category (after all, they're much easier to find), and I think it's fair to question whether that's a good use of resources.
