The judge rejected the argument that (claimed) "private funding" bypassed that requirement:

Under 40 U.S.C. § 3307, anything beyond basic "care, maintenance, and repair" (which demolition of the entire East Wing and construction of a gigantic ballroom would obviously be) requires Congressional approval and oversight.
