Yet the ruling was fully aligned with Constitutional principles, regardless of who filed any briefs.
Businesses of all sizes have the right to challenge overreach by government and to seek relief from harmful regulatory actions. The D.C. Circuit’s opinion set an unreasonable standard for plaintiffs to prove that the court can remedy their injury. This would have made it nearly impossible for regulated parties to challenge that overreach.
