COLUMBUS, Ohio — House Bill 281, which would require hospitals to work with United States Immigration and Customs Enforcement (ICE) officials or face various punishments, was introduced to the Ohio House of Representatives on May 20.

The bill, sponsored by Ohio Rep. Josh Williams, R-District 44, has been referred to the Public Safety Committee.

What You Need To Know

If the bill became law, agents working on federal immigration enforcement would need to be given access to facilities and given information/evidence "to the extent permitted by federal or state law"
If they are denied access or information, they would make a report

Following an investigation, the hospitals could be penalized in various ways:

It states that hospitals would be required to allow entry to U.S. Department of Homeland Security agents/officers, federal law enforcement officers and state/local officers assisting these agents “for the purpose of enforcing federal immigration law.”

Should this bill become law, they would be required to grant entry to the main hospital and any remote locations if these agents are pursuing federal immigration enforcement.

Those activities for which they would be granted access would be:

Making an arrest “pursuant to a lawful judicial or administrative warrant”

Conducting an interview with someone

Gathering information/evidence

“Subject to division (E) of this section, a hospital employee or contractor shall provide to an individual described in division (B) of this section any information or evidence that the hospital possesses, but only to the extent permitted by federal or state law,” the bill reads.

Per the bill, these agents would need to show that they are one of these above-mentioned agents working “only for the purpose of enforcing federal immigration law.”
