Concerning the above and just as an example I did some time ago become so exasperated by the rantings of Mervyn Hagger that I spent a modest amount seeking legal advice from a specialist.
I was of course fizzing with indignation at his comments that I was a liar,fraudster, a taker of funds under false pretences and that his explosive expose would collapse my house of cards such that I would reap the whirlwind of my duplicity.
At the very least I wanted him to be made to stop.
The lady lawyer first said that the idea of sueing Mervyn, probably following the popular notion that the plaintiff/instigator i.e myself might get a handsome pay out from the defendant, was for the most part mistaken.
She said of course that nobody sits down with a lawyer expecting to lose but that such is possible. She also said that it was not possible to estimate the cost of getting the case to court and further that if it were not a black and white case in my favour I may not get an award of costs or an award of damages. The defendant, she said, may not willingly pay. I may have to employ Bailiffs. If the defendant was a man of straw, a legal term for ' not having a pot to piss in ' I may never get my money, but would have to pay her in any case.
I suggested a simple ' cease and desist' letter but she said that if Mervyn was indeed as deranged as I imagined, such a letter may drive him to even more extreme action/publishing.
Finally there was a matter of the harm done as in her view if the few people reading Mervyns comments equally knew that he was deranged, then my reputation had not actually been damaged and in any case could not be quantified.
I was advised to let the matter drop and I dropped it.
So in the recent angry exchanges on the Garry forum, which have suddenly disappeared ( though nothing truly disappears from the Internet ), the pastime of gainful litigation is not as cut and dried as someone would have you beleive.
