It must be said that Dutch pirates have always been original in choosing their broadcast locations. Not hesitating to set up on an electricity or communication pylon.
Since the programs could be produced remotely and transmitted to the transmitter via the Internet, this cut off all links that could be exploited in court. The loss of a confiscated transmitter cost less than licensing and copyright fees.
We were also confronted with broadcasts of rave parties with heavy equipment: 75-metre telescopic crane for the antenna. It is very risky for the agents in charge of control to operate in a demonstration and even less to be able to ask for the help of the police.
Since this year, the National Inspectorate of Digital Infrastructures (RDI), which is responsible for monitoring the airwaves, has implemented a new policy of fines that increases the basic fine. This goes from €2500 to €7,500 and that's the minimum.
The RDI has divided the provisions covered by the fine policy into categories: the more serious the offence, the higher the category and the higher the base amount. The IFR takes into account, among other things, the seriousness of an offence, the degree of culpability and the offender's ability to pay.
Let's take the most favourable case of an individual: the basic amount for an offence classified in category IV is €150,000.
As long as there are no aggravating or mitigating circumstances, the basic amount based on steps 2 to 4 remains the same. Step 5 of the fine policy then takes into account the turnover or assets of an offender. If the fine concerns a natural person, a percentage of 5% is applied in step 5. In the example calculation, this means that the amount of the fine after step 5 is 5% of €150,000, or €7,500.
In the worst case and with aggravating circumstances, this can rise to €900,000.
Inspectors from RDI, the government agency responsible for detecting illegal radio stations in the Netherlands, have reported physical assaults and personal threats at least ten times in the past two years.
