The Justice Department on Monday moved to drop its defense of President Donald Trump’s executive orders aimed at punishing major law firms, a rare legal surrender that ends a saga that roiled the legal community.
Four judges, in separate cases, previously rejected as unconstitutional the executive orders, which sought to cancel government contracts of the law firms, suspend their security clearances and restrict employees from entering government buildings.
The Justice Department appealed those rulings in June and was expected to file its opening brief on Friday.
The decision to drop the appeal, first reported by The Wall Street Journal, comes nearly a year after Trump’s first order targeting the law firm Perkins Coie, citing as justification the firm’s 2016 work for Hillary Clinton’s presidential campaign and its affiliation with Democratic mega-donor George Soros. It then moved against Paul, Weiss, Rifkind; Wharton & Garrison; Jenner & Block; WilmerHale; and Susman Godfrey.

An email sent to Liberty University School of Law students over the weekend lays out, in refreshingly unvarnished terms, what the administration’s hiring pipeline actually looks like. And it’s exactly as bad as everyone suspected:
The two most important requirements are you MUST be aligned politically with President Trump and his administration and you must be willing to work hard. Don’t be scared off by the transcript requirement. GPA is not a strong factor. If you meet those two requirements, you have a shot.
Imagine a career services office writing this paragraph and not expecting it making a laughingstock of the law school? “GPA is not a strong factor” doesn’t make for a ringing endorsement of any law school’s mission. Telling students at a law school ranked in the 140s that their GPAs don’t matter if a candidate is politically correct enough is just open mockery of the curriculum.
