The question surrounding former national security adviser John Bolton and whether he will be called as an impeachment witness loomed over an unrelated court hearing today.
Bolton's name was never spoken but federal Judge Randy Moss hinted in court at the possibility the former Trump national security adviser could get called to testify. (The hearing wasnít about impeachment or Bolton at all; instead, itís a case where the House is fighting the executive branch for Census documents.)
Moss asked the Justice Department attorneys in the DC federal courthouse what would be done if Bolton was subpoenaed in the impeachment trial.
Lawyers from the Justice Department glanced at each other. DOJ attorney James Burnham, standing before the judge at the podium, tried to dodge the question, saying that this isnít at issue in the Census case.
Then, Burnham answered, saying the Justice Department would bring forward a lawsuit, Burnham said.
The administration could attempt ďto enforce the sovereign privileges,Ē he added ó such as keeping presidential deliberations secret ó by going to court.
