However it is still true that they don't award a Nobel prize for best attempted chemistry.  Previous Message It has been a loooooong time since I’ve looked at crim law, but the MD statute says you need the following elements: 1. that the defendant took a substantial step, beyond mere preparation, toward the commission of murder in the first degree; 2. that the defendant had the apparent ability, at that time, to commit the crime of murder in the first degree; and 3. that the defendant willfully, and with premeditation and deliberation, intended to kill (name). I *guess* showing up in front of BK’s house with a kill bag is a “substantial step,” but that doesn’t sound like slam dunk. Perhaps it is if you consider his alleged statements of his intent. I should read up more on this.
