"I have made the following list in order to finish with stupid gossips from Press articles (such as the diamonds in the Duchess of Sussex’s engagement ring come from QEQM’s Sapphire and diamond brooch.
This list was only made from a juridical point of view following the information we have in our possession. Obviously, we do not have access to the protocol of divorce.
Nevertheless, it is logical that, jewels given by British Royal Family or as « Princess of Wales » would be kept, according to tradition within the Royal family.
Different press articles (From Beth (thank you so much), - thanks also to British royal jewels on instagram - Franck) do confirm the position : “During her lifetime, Diana will keep the jewelry and family heirlooms she was given as Princess of Wales, but, according to tradition, they will be passed down and kept within the royal family ».
Obviously, I just wanted to understand the divorce settlement. I do not want to comment about the tax consequences (Even though I am a Tax lawyer).
I also do not want to comment about the situation of her children. Even though you can have the most beautiful jewels in the world, the lose of your mum (when you are so young) must be a real nightmare until the end of your own life.

ii. A sapphire and diamond watch (gift which was presented to her at the 1983 International Spring Fair in Birmingham;

i. The graduated diamond flower cluster necklace (mostly on loan from QEII);
ii. The six-row pearl choker with a large pearl surrounded by diamond + earrings (mostly on loan from QEII);

I’m afraid you are over thinking things, dreaming up some quite bizarre scenarios and ignoring the fundamental point that drives all points when one considers the ownership of assets:
Tax.
The Queen is the only person who isn’t liable for any tax in the United Kingdom. Important point to note, she pays Income tax on a voluntary basis. The monarch is also exempt from capital gains tax and inheritance tax so we can assume that almost all of her estate (including jewellery) will be inherited by the Prince of Wales and in due course by the Duke of Cambridge etc.
The reason why the Queen can inherit and pass assets tax free is to ensure that items associated with the Crown do not need to be sold to cover inheritance tax.
On that basis she has no need to shield assets such as jewellery within Trust structures or the Royal Collection. I do not know on what basis you assert the Queen treats her personal jewels as state property, I know of no evidence of this and for her to do so would be both bizarre and illogical. She loans items to family members because it is the entirely logical thing to do, to gift items would not only deplete the Royal Family’s collection but create an inheritance tax nightmare for the recipient.
