Third-party NIL deals over $600 are subject to review. This means deals with individuals or entities outside of the institution, like collectives or brands, will be scrutinized. s The review takes place via the NIL Go platform. This clearinghouse will help determine the fair market value of the deals.
Deloitte will employ a 12-factor analysis to determine fair market value. These factors include:
Athlete's marketability and social media presence Athletic performance and public profile Scope of deliverables (e.g., appearances, content) Geographic market size and demand Deal duration and exclusivity Comparables in the market Involvement of booster entities Timing of the deal (recruiting/transfer)
A three-step process is utilized to review the deals. This process involves verifying the payor's identity and intent, and reviewing the deal details and supporting documents. The aim is to prevent inflated deals and ensure legitimate NIL arrangements. Deloitte's role is to ensure deals aren't used to circumvent revenue-sharing caps or mask pay-for-play schemes. Deals can be cleared, flagged for review, or require more information. If a deal is not cleared, the athlete has options, including renegotiation, proceeding at their own risk, canceling the deal, or requesting arbitration. Deloitte will not unilaterally block deals, but instead provide assessments to inform the athlete's decision. There is an arbitration process for disputed deals. If a deal is rejected, the athlete can seek arbitration, with decisions expected within 45 days. Athletes remain eligible during the review process.
It is important to note that the NCAA is not directly involved in enforcing NIL deals under this new system. Instead, oversight is shifted to the power conferences, with Deloitte as the independent clearinghouse. Deloitte's decisions are subject to review through the arbitration system and by the courts.
