at the state level. It also doesn't require a conviction, but that had nothing to do with the decision. I'm unhappy about that but it makes sense that individual states shouldn't be allowed to use it on a state level, effectively affecting a federal election by causing a candidate to forfeit a given state and thus handicapping him/her. The danger in allowing states to decide this is obvious when yiu take tRUMP out of the equation. Any given state could muck up federal elections by using any of the provisions in the 14th amendment or any other amendment or provision in the constitution they could dream up as applying.. If one is okay, then they all are. Bush beat Gore based on one provision of the 14th amendment when it was applied on the federal level. Imagine if any given state had applied some part of the amendment to decide that election? It was awful enough that the SCOTUS stopped the ongoing recounting of ballots under the equal protection clause but it was done at the federal level and not at the whim of any state.
