Sure...but not a capital crime, and certainly not one punishable by summary execution. At best, that ICE officer panicked in a not-particularly-threatening situation. At worst, he'd decided to shoot at or even before he drew his sidearm...which happened while the car was still in reverse, as the video shows.

Should she have stopped and gotten out of the car? Probably so, at least in retrospect. But at the time, she was clearly afraid for her safety, just like people are saying the officer was. Only as it turns out, with vastly more reason.
