She basically couldn't do either because what was before her was strictly regarding the appointment of Lindsey Halligan, a decision that caused the indictments to be vacated.
She added "dicta" to the judgment that can allow the original judges assigned to each case the platform to get together and both issue simultaneous rulings that dismiss WITH prejudice and that set the stage for Comey and James to sue trump for vindictive prosecution and improper appointments. Then they can recover their attorney fees and allow the courts across the country to remove ALL of his improper appointments and force him to be unable to keep using interim 120 day appointments to skirt the authority of congress, which he did for all of his first term.
Both cases were in other courts before she was tasked with deciding if the appointment of Lindsey Halligan was legal. So THEY each have to dismiss from their courtrooms too, simply procedure since the cases are dismissed already, but HAVE the authority to make it final (with prejudice). They can officially rule that it was vindictive prosecution.
What she also did was rule that the government essentially CAN'T recharge them by using the first indictment to extend the statute of limitations so no matter whether it was with or without prejudice is moot anyway.
