European countries are free to licence transmissions in the shortwave broadcast bands by any organisation, they are then subject to the broadcast codes and legislation of that particular country. They can also choose not to licence stations in those bands or just issue a licence to one operator.
Trevor Brook, who wanted a licence for Radio Fax on shortwave, challenged this. I used to give his campaign publicity in the World DX Club magazine when I was one of their editors. He took the issue to the High Court and then to the European Court of Human Rights.
The then Government spent taxpayers money, the amount was published at the time, defending their right not to grant him a licence. You can read the ECHR judgement on this page.

BBC transmission had been privatised by then so anyone could buy time on what was then Merlin Communications. They'd acquired this monopoly by default.
