Day 3 of my trial, we lose a juror to a panic attack because she became claustrophobic in the jury room with 13 other people. 2.5 hours later one of the jurors starts nodding his head and I thought he was getting sleepy. Then he made this unbelievable guttoral noise, took an agonal breath, his head went straight back into the wall and down to his chest. He sweat so much, so fast that it looked like someone hosed him down and he turned gray. It was terrifying.
My client is a radiologist. The co-defendant is an ED doc. My guy went right to him, but had little to offer. The co-defendant ED doc, looked like he wanted nothing to do with the situation. Thankfully, my client's daughter is an ED doc and she jumped into action, keeping the guy alive until the fire department and ambulance arrived.
Plaintiff moved for a mistrial, so we will get to do this all again in 10 to 12 months. Sigh.
