NJCAA Ruling

A U.S. District Court has granted a preliminary injunction allowing JUCO athletes to retain all 4 years of NCAA eligibility, even if they play 2 years at the JUCO level. While the ruling is not final, it’s a game changer for College Sports!

There, I fixed it for you. If I am reading this correctly as well as taking the judges questions into account this is strictly an injunction in this case. The judge specifically asked the NCAA lawyers how quickly they could be prepared for trial. Then asked the NCAA lawyers when the transfer portal window would close to which they responded December 28th and that they could not prepare or proceed to trial that quickly. Hence the judge granted an injunction preventing the NCAA from preventing This Student Athlete from entering the portal and continuing his eligibility. This quite possibly could be litigated before the student athlete steps onto the field next August and his eligibility is revoked. I for one am skeptical of his chances of success in court and I don’t see this having any impact on college softball. Did I miss understand the relevance to softball?

Yes you are correct, the lawsuit names the NCAA. However the injunction and the contents therein specifically address this student athlete’s status as it relates to his eligibility. In order for the case to create a ruling that would benefit or harm other sports wouldn’t the plaintiff need to become class action. I suppose the plaintiff could possibly tailor the arguments to argue all student athletes are harmed but their case is already before the court so I’m not certain they can change direction midstream without harming the arguments already presented. How do you see the benefit to softball should this student athlete be successful in this case? There would need to be an incredible talent languishing in JUCO just as he was to then follow his example I should think for this case to be of any help.

My kid's schools would always play a couple of JUCOs in the fall. Every JUCO had a couple of kids that met eye test during the game. I'm guessing there are a few kids who couldn't make grades that otherwise would be playing at a four-year year for money. It would be nice to see the ones that put the work in not get penalized at the next level.

I know a very good softball player who has seven siblings. The parents did allow them to play travel and club sports, but they had to chose the reasonable/local options. With that, her exposure was very limited. She chose to go the Juco route, coming out of year two with zero debt owed.

There are many reasons why players end up at a Juco besides grades. But with these rules, it may open up that option even more.

I agree, if you can have a player that is 2 years more mature and stronger and they still have 4 years eligibility, same as a high school player, why not.

I'm certainly not an attorney, but precedent affects future cases.

Case law is a collection of judicial decisions that serve as principles for interpreting the law and deciding how to handle new cases.

That would be a positive for everyone. It would make the JUCOs instantly relevant from an athletic standpoint, and let's face it: it would be a great deal for the players and families. Get the prereq out of the way, and if you succeed athletically, go finish undergrad and grad school in the next four years.

Kids who want to go to a 4 year college for the experience and education will have less opportunities to play because kids two years older coming out of juco will take those spots.

The best kids will see the field no matter how they got there.

You need to think of it this way. Athletes have the potential to have another 2 years of college paid for. They could be graduating with a Masters degree. How is that a bad thing?

Huge positive daughter decided to go D1 over everything, hit the portal in the end went to another school, and played here and there.

In hindsight, had this been an option, and had years gone counted against her eligibility, this route would have been the best for her.
