…using their sudden concern with potential outcomes of their states’ rights principles that only manifested in this case when the result was politically inconvenient as a cudgel, rather than a direct argument on the merits of this decision. Seems like beating a dead horse to point out their hypocrisy and motivated reasoning, but if you need to crank out weekly columns there’s only so many original topics. Previous Message Previous Message All she does is take jabs at the Court for what she thinks is "dodging" the situation and burdened by "anxiety" and "dopey" pragmatism. Some of that may be true. She doesn't try to rebut even what her fellow liberals said regarding why they may overturn. People also often want the Court to decide relatively narrowly when they can, as they may do here.
